Privacy Policy

This document describes how we treat the data you provide us with or that we gather through any site or application offered by FERGUS MEDICAL S. A., headquartered in Avenida Manuel Savio s/n, Lote 3, Manzana 3, Parque Industrial Ferreyra, Cordoba, Cordoba, Argentina (“FERGUS”), regardless of it being owned by it or by its vendors.

 

First, we will establish the general privacy conditions related to the FERGUS (FERGUS MEDICAL S. A.) webpage or “FERGUS Website”, and then we will deal with particular cases (e.g.: specific terms related to the treatment of data provided via forms).

 

 

  1. General Terms

 

In compliance with the provisions of the Argentine Personal Data Protection Act (Ley de Protección de Datos Personales) No. 25,326 and its complimentary regulations (the “Law”), you hereby consent to the treatment of your personal data and/or personal sensitive data by FERGUS as established by the Law.

 

The FERGUS Website is owned and operated by FERGUS, but the information you supply will be accessible to our affiliates in other countries subject to the terms detailed below.

 

Plus, if you visit this site from a country different from Argentina, your communication with us will necessarily result in international data transfer. The legal personal data protection level is not equal in all countries around the world. However, we will implement the safety measures described in this Privacy Policy in an effort to keep your information secure. By using this site, you agree to your information being gathered, stored and processed in Argentina and any other country we may transfer it to during our business operations.

All personal data received by FERGUS will be treated with the utmost discretion and confidentiality. Our company has deployed all the appropriate technical and organizational means to prevent the loss, misuse, tampering, unauthorized access or copy of the personal data supplied. Notwithstanding the foregoing, it is impossible to guarantee the complete security of the transactions; which is why we have created a help line so that you can report any suspected activity that threatens this security to [email protected].

 

Your data will be maintained only for as long as they are strictly necessary for the goals of the treatment specified depending on the point of capture (e.g., by means of “cookies” – see the Cookie Policy – or when filling the contact form in the Cookie Policy site), without prejudice to its conservation to be made available to the relevant authorities when legally required or in response to legal claims.

 

This Policy may be updated from time to time, so we advise you to check the date of the latest version, to which you will agree by navigating the sites. We reserve our right to change it without notice.

How Is Your Data Collected

We may gather data in two ways.

  • You provide us with the data: FERGUS may require your data for a specific activity (to send you information, trainings, etc.). If so, you will be notified that you need to provide them and whether it is mandatory or optional. This information may be treated together with other information associated to you which you may supply or which may be collected by our systems.
  • The information systems collect the information automatically: the applications offered by FERGUS, which may be owned by FERGUS or a third party, may collect certain data, such as your browser type, computer or mobile device type, operating system, screen resolution or MAC (Media Access Control) address, while you navigate the site without requiring you to provide them.

 

How Is Your Data Used

When your data is collected, we detail the reason for use and, if it is mandatory, the legitimate basis for the processing (e.g., you may be asked for consent). Unless allowed by law, your data are kept for the purpose for which they were collected and according to the provisions in this Privacy Policy.

 

We may create a “business profile” based on the information provided, since FERGUS, like most companies, uses customer relationship management (CRM) databases to manage and track our marketing strategies. Our CRM databases include personal data collected through the FERGUS Website forms as well as other legitimate sources. No automated decisions will be made based on this profile.

 

We do not collect sensitive personal data unless it is done with a specific, explicit notice that requires you to consent expressly. Otherwise, you should refrain from giving us such information.

 

FERGUS may share your personal data to related companies (companies that are affiliated to, controlled by or subsidiaries of FERGUS). Furthermore, we may transfer information collected via the site to third-party service vendors who provide services to keep our navigation platform functioning (i.e.: infrastructure, hosting, traffic audits, applications, audits, etc.). We send business emails and other communications (via instant messaging, for example), as deemed appropriate by the Law, to those individuals with whom we want to develop or maintain a business relationship.

Email and other communications by FERGUS targeted to a specific segment may include additional information about data privacy as required by Law.

 

FERGUS only sends business communications if it is legally appropriate to do so.

 

You may exercise your right to refuse being sent marketing communications by not checking certain boxes in the forms we use to gather your personal data or by using voluntary exclusion mechanisms in the communications we send. In such cases, we will keep minimal personal data considering that you have opted out of participating so that we do not contact you again.

 

Minors

The content and services of the FERGUS Website are directed to users aged 18 or older. Our sites are not designed to attract younger users. If it comes to our knowledge that a user under the age of 18 has offered personal information in relation with the FERGUS Website, we will delete this information from our databases.

Your Rights

You may exercise your rights of access, rectification, cancellation, opposition or any other right granted to you by the applicable law by means of a written request to [email protected]. Keep in mind that we may ask for additional information to identify you when performing the request. We will comply with your request, if appropriate, within the legally-established period starting from the reception of your request in the mentioned email.

 

The Public Information Access Agency (Agencia de Acceso a la Información Pública), which is the controlling body for the Personal Data Protection Act No. 25,326, is tasked with receiving complaints and reports regarding non-compliance with personal data protection regulations.

 

In order to solve any conflict or litigation, regardless of its contract or non-contract origin, or of its judicial or extrajudicial treatment, due to or arising from the use of the FERGUS Website, any situation derived from its use or this Privacy Policy, which the Parties cannot solve amicably on their own, will be settled before the ordinary courts of the City of Buenos Aires, in the Spanish language, and the Argentine legislation will be the applicable law.

 

  1. Particular Conditions Regarding Contact Forms

By sending your data through the contact forms available in the FERGUS Website, you consent and authorize FERGUS to collect and treat the data you submit in each of the forms as per the terms of this Policy.

 

You agree to provide true and accurate data and to update them if necessary. The data you will be requested may include the following:

  • First and last name
  • Type of visitor (health care professional, patient, health institution, funder, distributor, vendor, general audience, public entity, other).
  • Medical specialty that you are inquiring about
  • Province of residence
  • City of residence
  • Contact phone
  • Email address
  • Type of inquiry

 

Personal data requested and provided through the forms in the FERGUS Website will become part of a personal information database created and maintained by FERGUS MEDICAL S. A. in order to collect data for, mainly, the following: sorting inquiries by visitor type and referring to the appropriate customer care representative; setting up contact profiles in the CRM based on the type of customer that has performed the inquiry; segmenting customer groups in the CRM for future direct marketing, automation or inbound marketing campaigns, when legally allowed; and sending information about the company, its products or services, or events related to the medical specialty of interest for the health care professional (if applicable).

 

These data may also be used for:

  • Addressing requests: submitting information, contacting you, notifying you about changes in terms, conditions and policies, and/or other administrative information; and
  • Business purposes: data analysis, audits, site improvement, product and service improvement, site use trend identification, site experience customization by showing products and offers tailored to you, and assessment of the effectiveness of our contacts.

 

The data obtained through forms in the FERGUS Website may be combined with other data held by FERGUS or that FERGUS may obtain in the future.

 

 

  1. Particular Conditions Regarding Subscriptions to Newsletters in the FERGUS Website

 

A FERGUS Website user may subscribe, by sending the data requested in the appropriate forms and selecting the relevant option, to newsletters that FERGUS may issue.

The personal data processed for the subscription to newsletters will be used to send product information related to the medical specialty of interest for the subscriber, to sort users based on specialty or medical interest and to set up contact profiles in the CRM.

At any moment, the user can opt out of the newsletters by contacting [email protected] or by pressing the link at the bottom of all newsletters to cancel the subscription.
